A marital property contract is a legal transaction, that is, a special type of contract by which the parties—the spouses—establish, amend, or terminate their matrimonial property relations, exercising the rights and options granted to them by law to independently determine the regime governing their property relations.

A marital property contract may be concluded either prior to entering into marriage or during the marriage; however, it is registered only after the marriage has been concluded.

The spouses may also agree upon the division of property without entering into a marital property contract.
